These Terms of Use (“Terms”) govern your access to and use of the TrustGuard IQ mobile application and related services (the “Service”).

The Service is operated by PrimaNuova Group LLC.

By using the Service, you agree to these Terms. If you do not agree, you must discontinue use of the Service.

1. Description of the Service

TrustGuard IQ provides AI-assisted decision-support tools designed to help users evaluate potential risk indicators in situations such as suspicious communications, transactions, or interactions.

The Service analyzes user-provided information and generates informational outputs intended to increase awareness of potential warning signs.

The Service does not detect scams, monitor accounts, investigate fraud, or guarantee the identification of fraudulent activity.

2. No Professional Advice

Information provided by the Service is for informational and educational purposes only.

TrustGuard IQ does not provide:

• legal advice • financial advice • cybersecurity advice • investigative services • professional consulting services

Users remain solely responsible for their own decisions and actions.

If professional advice is needed, users should consult qualified professionals.

3. AI-Generated Content Disclosure

The Service uses artificial intelligence systems to generate outputs based on user-provided information.

AI-generated results:

• may be incomplete • may be inaccurate • may not reflect all relevant context • should not be relied upon as definitive conclusions

Users acknowledge that AI outputs are probabilistic assessments, not factual determinations.

4. No Guarantee of Fraud Detection or Loss Prevention

The Service is designed to provide informational pattern awareness only.

TrustGuard IQ does not guarantee the identification of scams, fraud, or deceptive activity, and the Service cannot prevent financial loss.

Users acknowledge that:

• fraudulent activity may occur even when warning indicators are absent • legitimate situations may display characteristics similar to scams • no automated system can reliably identify all fraudulent activity

TrustGuard IQ shall not be responsible for financial losses, transaction decisions, or actions taken based on use of the Service.

Users remain solely responsible for verifying information and exercising independent judgment before engaging in transactions or communications.

5. User Responsibilities

You agree to:

• use the Service only for lawful purposes • provide truthful information when using the Service • avoid submitting highly sensitive personal data • exercise independent judgment when making decisions

You are solely responsible for actions taken based on the information provided by the Service.

User Responsibility for Submitted Information

Users are solely responsible for the information they choose to submit into the Service.

Users agree not to submit highly sensitive personal information, including but not limited to:

• passwords • financial account numbers • authentication codes • government identification numbers

TrustGuard IQ does not require or request such information.

Users acknowledge that information entered into the Service may be processed by automated systems in order to generate analysis outputs.

6. Acceptable Use

You agree not to:

• exploit vulnerabilities in the Service • attempt to reverse engineer the software • use automated systems to overload the platform • interfere with security features use the Service in violation of applicable law probe, test, or exploit vulnerabilities in the AI system • generate excessive automated requests intended to degrade system performance • attempt to reverse engineer or extract underlying AI models • use the Service to create fraudulent, deceptive, or unlawful content

TrustGuard IQ reserves the right to limit, suspend, or terminate access to users who engage in abusive or disruptive behavior.

7. Intellectual Property

All intellectual property associated with the Service, including:

• software • algorithms • user interface design • trademarks • branding • analysis frameworks

is owned by PrimaNuova Group LLC or its licensors.

No rights are granted except those expressly stated in these Terms.

8. Subscriptions and Payments

Certain features of the Service may require payment or subscription.

Payments are processed through Apple App Store or Google Play billing systems.

Subscription management, billing disputes, and cancellations are governed by the respective app store’s policies.

TrustGuard IQ does not control third-party billing systems.

9. App Store Compliance

If you download the Service from the Apple App Store, you acknowledge that:

• Apple is not responsible for the Service • Apple has no obligation to provide maintenance or support • Apple is a third-party beneficiary of these Terms

Use of the Service must comply with Apple’s App Store Terms of Service.

10. Warranty Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, TrustGuard IQ disclaims all warranties including:

• merchantability • fitness for a particular purpose • accuracy of information

We do not guarantee that the Service will identify scams or prevent losses.

11. Limitation of Liability

To the maximum extent permitted by law:

PrimaNuova Group LLC shall not be liable for indirect, incidental, consequential, or special damages arising from use of the Service.

Total liability shall not exceed the amount paid by the user for the Service during the previous 12 months.

12. Indemnification

You agree to indemnify and hold harmless PrimaNuova Tech LLC and its affiliates from claims arising out of:

• misuse of the Service • violation of these Terms • unlawful conduct

13. Arbitration and Class Action Waiver

Any dispute arising from the Service will be resolved through binding arbitration rather than court litigation, except where prohibited by law.

Users waive the right to participate in class action lawsuits.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

15. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

16. Changes to the Terms

We may modify these Terms periodically.

Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
